Das Werk von John Alderson FOOTE (1848-1922) stellt die nächste Stufe in der Entwicklung des Private International Law nach dem Erscheinen des Werkes von Westlake. In seinem Vorwort bekennt Foote, dass neben dem Werk von Westlake vor allem der umfangreiche Kommentar von R. Phillimore Einfluss genommen hat. Ausgangslage seiner Darstellung ist jedoch das große Werk von Joseph Story “Conflict of Laws”. Sein Werk, so berichtet Foote, folgte jedoch nicht den bisherigen Publikationen, die ein Private International Law aus den juristischen Entscheidungen vieler Nationen und aus den Werken der unterschiedlichen Juristen, die aus der ganzen Welt eine Methode und Wissenschaft vom International Private Law ausgestaltet haben. Sein Werk sucht vielmehr die Masse an Entscheidungen im englsuichen Rechtskreis, die mehr oder minder chaotisch überliefert sind, zu systematisisieren und einer geordneten Beschreibung zu überführen: “The English decisions, on the other hand, which have been built upon that foundation still remain a more or less chaotic mass”. Und gerade seit der Publikation des Werkes von Westlake, habe sich das Internationale Privatrecht in England stürmisch entwickelt. The next stage in the development of private International law after the publication of the work by Westlake is “Private International Jurisprudence” by J. A. Foote (1848-1922). In his preface Foote acknowledges that he was influenced not only by Westlake’s work but above all by the comprehensive commentary by R. Phillimore. The starting point of his presentation is however the great work by Joseph Story, “Conflict of Laws”. His work, Foote reports, did not however follow the previous publications that shaped a private international law from the legal decisions of many nations and the works of different jurists and their methods and scholarly international private law. His work instead attempts to systematize the mass of decisions in the English legal system that are more or less chaotically handed down from generation to generation and give them an ordered structure: “The English decisions, on the other hand, which have been built upon that foundation still remain a more or less chaotic mass”.
